PJC 103.3 Duty of Good Faith by Express Contract (Comment) Parties may create a duty of good faith and fair dealing by the express terms of a contract not governed by the Uniform Commercial Code. The basic question in PJC 101.2 should be used to submit all contractual provisions including the express duty of good faith and fair dealing.
