PJC 6.2

False Imprisonment—Instruction on Unlawful Detention by Threat

“Detention by threat, violence, or other means” requires proof that the threat was such as would inspire in an ordinary person just fear of injury to his per son, reputation, or property.

COMMENT When to use. PJC 6.2 is appropriate in cases in which there is a question about the existence of a detention. In such cases, if the detention is allegedly made by threats, violence, or other means, an instruction relating to this type of detention should be given. Randall’s Food Markets, Inc. v. Johnson , 891 S.W.2d 640, 645 (Tex. 1995). See PJC 6.1.
