N ONMEDICAL M ALPRACTICE —T HEORIES OF R ECOVERY

Termination. If there is evidence of termination of the relationship, the following instruction may be added to PJC 61.11: An attorney-client relationship does not exist if either the client or the attorney has terminated the relationship. The client may terminate the relationship at any time by communicating the termination to the attorney. The attorney may terminate the relationship after taking reasonable steps to avoid foreseeable prejudice to his client. Note that an attorney’s withdrawal from employment is governed by Tex. Disciplinary Rules Prof’l Conduct R. 1.15, reprinted in Tex. Gov’t Code Ann., tit. 2, subtit. G, app. A (West 2013) (Tex. State Bar R. art. X, §9), and the above instruction should be modified to comport with its requirements.
