Divorce
QUESTION 1 Do grounds for a divorce exist?
[Include instructions only on grounds that are supported by the pleadings and evidence. Fault grounds listed in Texas Family Code sections 6.004–.007, although not shown as examples below, may be appropriate in the particular case.] A divorce may be granted without regard to fault if the marriage has become insupportable because of discord or conflict of personalities that destroys the legitimate ends of the marriage relationship and prevents any reasonable expectation of reconciliation. A divorce may be granted in favor of one spouse if the other spouse is guilty of cruel treatment towards the complaining spouse that renders further living together insupportable. A divorce may be granted in favor of one spouse if the other spouse has committed adultery. Answer by writing “Yes” or “No” as to each ground for divorce.
