COMMENT Source. The first paragraph of the foregoing instruction is based on Tex. Fam. Code § 3.102(a). The second paragraph is based on Tex. Fam. Code § 4.204. The third paragraph is based on Tex. Fam. Code §3.102(c). The fourth paragraph is based on Tex. Fam. Code § 3.102(b). The fifth paragraph is based on Tex. Fam. Code § 3.101. When to use. If management, control, or disposition of marital property is in issue, the foregoing instruction should be given with PJC 202.1 (separate and commu nity property). If property converted to community property by agreement of the spouses is not in issue, the second paragraph of the instruction should be omitted. If management, control, or disposition of separate property is not in issue, the fifth para graph of the instruction should be omitted.
